Pete Williams on NBC said Mueller will be reporting to this acting attorney general.
Because Sessions technically "resigned" Trump can name a temporary replacement under the Vacancies Act. This allows him to circumvent both normal succession and Senate confirmation.

Pelosi can rehire him to work for Congress, but she can't force the DOJ to give Mueller any resources or co-operate with Mueller in any way. The most Mueller could do working for Congress is issue criminal referrals to the DOJ that they could completely ignore if they wished.
Only Trump could create a timeline where Sessions being out of the government was the worse of two options.
