Eh, the person getting shot shoved the man and was parking in the wrong spot. I'm trying not to side with the shooter, but it's not easy.

Not easy? Come on man, I hate people who park in spots reserved for others too, and getting shoved by that person would fucking piss me off too, but it's not then okay to kill that person. Calling the cops would have been acceptable, not this. One reason not to carry weapons. People can and do get angry and angry people don't think things through.

I don't see how he is standing his ground.... while the push was unnecessary it didn't seem like he was moving to attack him further. Once he got the guy away from his gf he stopped and the guy pulled the gun out and shot anyways. Truly awful.

Watch the video the shooter is confronting the mans girlfriend/wife so the victim runs up and shoved this psychopath away from her. I would do the same thing in the same situation to defend the person I love. Once the man is on the ground the victim doesn't escalate it, he steps away. There's no excuse in the world that could make any sense.

I just don't see how this fits stand your ground law. I'm not seeing it. Yea, he shoved him. After that there was at least 5 ft of space between them with the guy that shoved him moving AWAY from the idiot on the ground. Stand your ground is supposed to protect a person that was fighting off lethal force.

Wish it could be as simple as the Castle Doctrine which is great. Not sure stand your ground in any capacity will ever be that simple.

The nightmare endpoint of this law is that someone shoots this guy upon seeing him and uses this incident as justification.

"I had to shoot him, before he Stand Your Grounded me"

I really fucking hate this state sometimes. I have a good job and I'm raising my kids here, but damn if I don't worry about them every time they go out. I've already had a number of talks with them about not confronting people and just walking away. It's just so fucking dangerous now for no reason. Just so goddam stupid.

I would never bother with someone like that, just carry on with my day. Not trying to be some psycho's victim.

I hope people protest and Drejka winds up in jail. Being shoved to the ground is no excuse to kill a man. Brandishing the gun would've sufficed, but giving the guy no time to react and blasting him is NOT self defense. Florida is fucked up.

Didn't stand your ground not apply to the woman who fired warning shots when her abusive ex showed up at her house?

Is there a "whiteness clause" in stand your ground?

It didn't count because she fired warning shots. That means she had time to react and her life wasn't in imminent threat. However, if she had shot him, she could use stand your ground.

If he would have advanced after that and went to get on top of him it would have been fully justified. But the guy backed off after the assault so it went from being an assault to unjustified shooting

User Banned (1 Week): Aggressive concern trolling and rationalizing a lethal shooting
yeah getting pushed to the ground definitely calls for an on the spot extrajudical execution in front of the child. The shooter must be your hero

what an amazing country

Who cares about the pushing? I already said the crime was parking in the illegal spot. Shooting the man was unjustified, however the driver deserved to be berated and at the very least have his car towed away. A beat down would've been in order not execution. The driver should've accepted he committed a henious act and bowed his head in shame.

Dude just wanted a reason to use that gun and he found one after he was shoved. I wouldn't be surprised if he was trying to provoke a similar reaction the other times he harassed people over the spot.

This what happens when a consortium of retailers write your laws word for word. This is the handiwork of the Koch backed ALEC.

Why can't ppl mind their own goddamn business? This piece of shit shot someone over a parking spot. No, the driver should not have parked in a handicap spot but it's not this shit head's problem. And now someone is dead because of it.

Nah, you can't justify this killing in any shape or form. Even if the driver hit him with fists there was no reason to basically execute him in front of his family.

Could America have a referendum on the 2nd amendment rights like how Ireland did recently for abortion?

Just a big vote to get it removed/keep it.

This is what happens when Marion Hammer writes your gun laws and you enact them verbatim.

Stand Your Ground was introduced in the Florida legislature in December, 2004. Though no one realized it at the time, it would become the N.R.A.'s most controversial law. "Marion was the ringmaster," Dan Gelber, who later served as the House Democratic minority leader, said. "It was her circus. She was telling everyone where to go and what hoops to jump through." Before Stand Your Ground, Americans were forbidden to use force in potentially dangerous public situations if they had the option of fleeing. The new law removed any duty to retreat, justifying force so long as a shooter "reasonably" believed that physical harm was imminent. It was a radical break with legal tradition. Now a person's subjective feelings of fear were grounds to shoot someone even if there were other options available.

Read this article. It is absolutely chilling.

This law is so dumb. Could the girlfriend be justified in shooting the guy on the ground because she felt her life was in danger once her boyfriend got fucking shot?

I am always cognizant when I go to the States of things like this. Any sort of conflict that occurs on the street is going to be met with gunfire, no matter how minor it is.

Its messed up that this law seems to have the same threshold for killing that police officers in the entire country use for 'threats.'

In the next 20 years, no way. Way too many Americans in power love their guns.

But the kids today growing up with school shootings happening every week, when that generation is finally elected in 30-40 years, I truly do believe the 2nd Amendment will be gutted or perhaps even nullified with a new Amendment.

To me a Referendum/Plebiscite is one of worst idea to decide anything concerning individual rights. It should never be put in the hands of general population... (bad ideas to put in a plebiscite: abortion, gay marriage, religion). We should be very very careful put anything in a plebiscite/referendum.

I suppose the law technically sort of fits since he pushed him. But that person said he waits there to argue with people about the spot. He goes looking for a fight. They would probably need to look at survailance of the store to show how often he hug around there. I think its a good case for premeditated murder for a random next person to trigger him.

No. If he brandished the gun it would have been illegal.
