It likely is if I would guess. Nintendo has weirdly always like horror, even if they don't do a lot with it.

Not necessarily, it can be an estimate, like "Yeah, we think this is going to be M rate." It's done all the time.

Not really, having a straight-up rating means that the ESRB has already evaluated the game. There's another note for games estimated to be rated M by the developer but wasn't yet fully evaluated by the ESRB...
