It would seem pretty silly to me if Microsoft had to ask for permission to X enhance any game. Yes they need permission for them to be used in the emulator, since they are hosting and distributing the game files, but everything else should not require any permission. Microsoft is not modifying or altering the code in any way, and it seems pretty crazy that a resolution bump would require an express permission from a publisher, especially since the regular BC already comes with other graphical perks such as 16x AF, faster loading time, better framerates, ect.Yeah, the wonder of MS's software team really is incredible.
I have to wonder what politics go on behind the scenes to get a game "enhanced" on the X.
For example, I could see EA not letting MS do that to the Mass Effect Trilogy due to them wanting to make it themselves and charge $60 + paid DLC. That's a worst case scenario there, but outside of first party games, their BC starts encroaching on the remaster market that has become popular this gen.

Crackdown 1 is/was by far the best new first party ip xbox 360 had.Been Playing through Crackdown for the first time and wow, these enhancements make it look so clean! It's really crazy how good it looks for how old it is. Plus enhancements aside, it turns out Crackdown is super crazy fun. This enhancement initiative rocks, I hope they keep adding more.
