In the school scenario, what if they were doing it with a window nearby where any passerby could see them? Or in a school room where another member of staff opened it? The first is clearly public but the 2nd is not so straightforward.

I honestly don't think either should result in prison time. Fines sure. Civil damages maybe. But prison time? No. Same reason I don't think you should get prison time for having sex in your car in a parking lot. Or prison time for having sex on a beach that you thought was secluded.
