Copying the original serverside code is definitely piracy. I mean that should not be in doubt ever.
The client is a bit murkier, but since it was provided free of charge when the game was running, it'll be a tough argument to say people aren't allowed to have those files.
They are now saying on Discord that there was no C&D from NCSoft, and some random developer just got spooked or something.

A lot of us loved CoH and its sad we can't play it unless we were part of some elite ass club.
But they loved it enough to form a community and find a way to play it. they don't owe you anything because you have a similar interest
They were handed the server code on a silver platter which they used to create their own exclusive secret club. The only work they put in was engaging in a campaign of gaslighting the tight-knit CoX community, sabotaging other efforts to create private servers and conducting a conspiracy to hide the existence and deny even the possiblity of a private ever existing.

Btw the best way to actually ensure the game will live on forever is to release the code openly and freely in the first place when one of the original game devs handed them the code

I am so nervous about them shutting down Guild Wars someday. That source code is not getting released.

As far as we know, NCSoft was not involved in this at all. It was simply the act of a random person wanting to get a kick out of it. The details around it are a bit hazy, but the bottom line is NCSoft had nothing to do with what occurred today.

Yes, just release the code. That's a selfish take.
That's always thrown out there as a "solution" while ignoring the legal aspects of it for the person that potentially does it.
There are many things that people would love to release (speaking generally here, not just of this game) but aren't going to do so because they don't want to risk getting sued to oblivion.
Oddly, the people who say "just release it" never pledge resources to cover legal costs.
