This fucker just doesn't understand or care how any of this works.

The president would be able to use as a piggy bank for wall construction money already appropriated by Congress for other Defense Department construction projects and Defense Department resources already allocated to Army civil works programs. Essentially, the ominously vast grant of emergency authority boils down to Trump's ability to shuffle around resources the Pentagon already has. Notably, in order to use this power, he would have to take money away from existing projects.

It's perfectly legal for him to declare the emergency. It seems iffy at best on whether anything will come of it, if there isn't actually an emergency.

It seems pretty much certain it will be fought and likely stopped - or at least extremely delayed.

No, that was only one option. It looks like he's exploring the possibility of using 33 U.S.C. § 2293.

In the event of a declaration of war or a declaration by the President of a national emergency in accordance with the National Emergencies Act [50 U.S.C. 1601 et seq.] that requires or may require use of the Armed Forces, the Secretary, without regard to any other provision of law, may (1) terminate or defer the construction, operation, maintenance, or repair of any Department of the Army civil works project that he deems not essential to the national defense, and (2) apply the resources of the Department of the Army's civil works program, including funds, personnel, and equipment, to construct or assist in the construction, operation, maintenance, and repair of authorized civil works, military construction, and civil defense projects that are essential to the national defense.

I don't see how a reprogramming of appropriated funds marked for DoD during a lawfully declared national emergency would be stopped. The way to stop the declaration of an emergency is through a joint resolution of Congress.

Would love to be proven wrong, however.
