Yay Netflix thread. I know I'm a few years late but I just started getting into Unbreakable Kimmy Schmidt and I'm loving it. I laugh out loud multiple times per episode. Up to episode 10 now.

Gonna start up Punisher at some point today. (I haven't watched any of the other series since Jessica Jones - that won't be a problem, right?)

Can't believe Longmire is finished. It had its ups and downs but I'm sad it's over. I liked this season a lot more than the previous one.

This Jim & Andy doc is tremendous. Man on the Moon is one of my favorite movies, so seeing this backstage doc is just amazing.

Jim really should have won an oscar for that movie.

Yeah, I loved the doc (and movie) too. It is crazy how Jim essentially embodied Andy to the point where it almost wasn't method acting anymore. He literally disappeared into that character.

He literally took a picture, top down, of a VHS tape. If they had taken a bit of artwork. A photo the guy had taken or an image he had masterfully adapted into a promo shot of the show, mweh, fine mate, you have a point. But a photo of a VHS tape? Is that really something you need to be worked up about?

He probably can't even claim copyright on it as an original work. He did nothing transformative to the VHS tape and he certainly didn't design or hold the copyright to that.

Seems dumb to not see a lawyer first for legal advice to make an informed decision on how to proceed.

I mean, this kind of flies in the face of photography in general. I'm fairly certain it is considered transformative.

It doesn't matter that it's just a picture of a VHS tape, the person who took the photo of it owns the copyright to it and Netflix can't use it without permission.

That's how US copyright law works. From the second that picture was taken the copyright on the picture was owned by the photographer. It doesn't matter that the picture is a top down picture of an item. Netflix didn't have permission to use his picture and the photographer has every right to sue them if he wants to (though I'm sure Netflix will pay him off before it comes to that).

I think at best netflix could argue that he doesn't hold a copyright to the material even though he took the photograph. This would be like saying there is a copyright but the copyright belongs to the producer of the original VHS tape which was merely photographed. I don't know if that'd be successful or not. Sometimes these things rely on facts individual to each case.

I can't imagine a scenario where they argue there is no copyright at all, but perhaps that is what they could argue since the burden is on the accuser here to show there is in fact a copyright and he owns it.

man Bojack s4 was excellent. Didn't hit as hard as s3, but the work they did on exploring Bojack's family tree was excellent. And once again that ep 11... This show continues to be fantastic.
