Bowser Jr. was definitely a part of an earlier SmashBoards leak (not 4chan, house of thousands of leaks), the one which started with Bowser palette photoshops. The thing is, few trusted it cause WFT made Gematsu's source the internet hit, and it slightly sabotaged itself due to naming the vehicle as "Mario Kart", which wasn't technically wrong but gave people the wrong idea. When ESRB images leaked, a lot of people immediately thought of that one, but then clips showed up and nobody cared anymore.
Is there a reason that company Eric works for now hasn't issued a statement about the whole Smash thing unlike the other place? Are they under NDA or they just don't want to be bothered? That whole video takedown was weird too.
The disappointment is great, but not surprising.
The worst of it may be that even as an assist trophy he still only gets that crappy move attack which is incredibly dull. Maybe one day...

As for making a statement, if they're not involved then there's no reason to. The worst they're facing is some nerds badgering them.

We have had Ridley and K Rool added as major villains and the current rumor is that there will be one more big first party character so Skull Kid doesn't seem to much of a stretch. Also, in the previous game he was an AT, in this game we haven't seen him yet, we did see the Moon as an AT so it could be that the Moon replaced Skull Kid so Skull Kid can be an actual fighter this time.
