Hiding the disable toggle behind two sets of menus and requiring you to opt-out of every individual advertiser is a shitty way to do it and also illegal according to Recital 32.

since the Privacy Policy page only mentions "you may be able to exercise that choice through opt-out programs that are administered by third parties, including the Network Advertising Initiative (NAI), the Digital Advertising Alliance (DAA)." without giving a link, I'll take a guess at "nope".

The link I saw was in the opt-out options popup itself, yeah. I was just looking for a link bringing me back to that options page.

It doesn't, the hidden "opt out of all" link just opts you out of the switchable ones. Which still leaves every single "Opt-out required" links unchanged. Should be the same as on mobile.

Just spent 9 months doing GDPR.
This implementation fails massively.

You're less at risk having nothing and saying you're dealing with it, than having the pile of junk that you have here guys.

Truly, it is the worst possible implementation of cookie consent. I know it's probably just something that got bundled with Resetera's forum software, but someone somewhere paid that company a lot of money to develop a GDPR cookie solution that goes out of its way to explicitly break all the GDPR regulations.

I know it's probably just something that got bundled with Resetera's forum software, but someone somewhere paid that company a lot of money to develop a GDPR cookie solution that goes out of its way to explicitly break all the GDPR regulations.

I'm fairly sure that this isn't included with Xenforo going by what the images look like nor was it mentioned in Xenforo's list of changes due to GDPR. Doesn't match Xenforo's style at all. Seems more like with was bundled with the ad service.

Depends if your company is doing any business in the EU (or ever wants to do any business in the EU). And to be precise here, "business" is a very generous term here, even ResetEra would fall under it as they offer subscriptions for ad-free use.

If that doesn't apply to your company, then sure, not enforceable. The same is true for the US as well, after all, lots of sites hosted overseas break US laws (copyright most of all, I assume)
So if ResetEra disabled EU specific ads and disabled EU users from buying the ad free service they would be in the clear?

It doesn't mean people in the EU haven't tried...

TL;DR: Project Gutenberg is an American web site that offers free downloads of public domain books. But a few of the books available for download are still under copyright in Germany. So the German copyright holder sued Gutenberg, the German court ruled in favor of the copyright holder, and Gutenberg ended up blocking access of their entire web site to Germany.

This happened back in February this year.
That's absolutely ridiculous. I feel bad for the German people. The books I presume were in English and not German, yes?

SG-17 one of the admins is german, might be(big might, because even after my mandatory gdpr training at work I still don't know) liable if someone would sue as they is one of the "owners", even if the servers are in the us.
but like i said. big might. someone with better knowledge could clear that up please?

The one time a forum wide pop up was absolutely needed and we get nothing.

I've rarely seen so many plugins/trackers in one website before.

GAF had something like 80+ trackers on it at it's height. Just another weird thing copied from the previous site. Blocking ads is sometimes the difference between loading a page <1 sec and having to wait >30 seconds before it stops lurching around. Or even longer, if somene has snuck a __coin miner into the ads.

EU isn't gonna go after some small american LLC for fines. Only reason you see newspapers and shit in the US blocking EU is because of their ad network, not themselves. EU would go after the ad provider, as they're the ones selling the slots, not Era.

I don't know if this was deliberate or if nobody looked into Era's provider of choice before using that system, but it's bad. I've deadass dropped a couple of sites that used the same scummy GDPR control panel out of principle.

They're actually German books, which is a large part of why the court in Germany claimed they had to operate under German law.

From the FAQ at the link in my previous post (note that PGLAF = Project Gutenberg):

"Q: So the court thinks that the presence of content in German means that courts in Germany have jurisdiction, regardless of the fact that PGLAF is entirely in the US?

A: Yes, that was the original basis of the claim for jurisdiction, which the Court accepted in their judgement. Since then, there some more recent decisions in the European Court of Justice, and other German courts, that support this theory based on a Web site being accessible from a country. I.e., if a Web site is accessible from Germany, there are some cases where German courts claimed jurisdiction over that site, even though it was operated, and based, outside of Germany. These cases involve companies that actually operate (for-profit) in Europe, and the cases were between two European countries (i.e. part of the EU). They are not consistent with prior laws and cases, even in Europe, and also not consistent with provisions of the Berne Convention and other international law.

In addition, PGLAF has pointed out that German is widely spoken in the US (the third-most common second language), and also is widely taught in schools and colleges. PGLAF has no actual presence or activity in Germany, and never did."

The FAQ has plenty more information, including a list of the 18 books and when their copyright expires in each country.

Those are just a couple of examples. Here's some more

The membership sign up, although free, would also come under GDPR as its a solicitation and storage of personal data so you would have to block EU users from that.

Any cookie that tracks an EU user would involve collection of data, so those would have to be disabled.

Any targeted advert displayed to an EU user, regardless of the origin of thd company advertised would have to be disabled.

At that point you either block all EU users, or comply which really isn't that difficult to do for a website like this with just a bit of thought.

imgur does the same shit and a bunch of other websites do too. Good to know resetera finally joined in. I try to opt out because I don't need your stinking advertising to track my shit but I get this giant list of scummfuckery and if I had to manually flip the switch on all of them (including the ones where I have to visit non existant websites to opt out) it'd take me literally forever.

This isn't true though.

If era only asks for data needed (which is login name and email/password), explains why the data's needed and what's happening to it, ask for permission to use these (which all should be covered in the registering process I'm sure) and links to a data agreement when registering, it's perfectly fine. And that's if you go all out.

The original question from that user was about enforcability and why a site outside of the EU should bother complying. I gave him a couple of examples earlier that he then asked if it would be enough to just avoid doing those. I then gave some other examples of things they would also need to meet gdpr.

The registration is something that would require gdpr compliance. I didn't mean to suggest it currently does or doesn't. I've honestly no idea as I haven't looked.

The registration process example you gave would comply. I'm not denying that. My point about blocking was that if a website really wants to avoid having to comply in any way with gdpr they would have to block.

I have my ad locker disabled on Resetera but I never get ads... I'm on the old interface though, because the colors of the new one make my eyes bleed.
Seriously, admins, if that's the problem, make a version of the new interface with the subdued colors of the old one. I bet I'm not the only one who gets a headache from the new interface.
Edit: I changed to the new interface and accepted (Again) the cookies, I still don't get any ads.

Fuck the way this was structured. Scummy trash. I literally sat there for 10 minutes clicking off on every single option. Not even sure what "requires opt-out" means. Is there any way to access these settings again? If not, that sound incredibly illegal. I would like to review my settings, either way.

Sorry Era but working with ad providers allowing to share user data with hundreds of third party companies is shoddy as hell. I know you are looking into this but ResetEra is waaaaaaaaaaaay too dependent und third party sites and content.

I done goofed, is there anyway to change once you've already agreed?

The annoying part is that not everything can be opt-out in this pop-up. You have to go on other websites that will send you on another one where you can opt-out from some other sites and few on the list are "mysteriously" unavailable, so impossible to fully opt-out.
