A former Dallas police officer was indicted on a murder charge Friday for killing an unarmed 26-year-old in his apartment, according to county court records.

A Dallas County grand jury delivered the indictment Friday after considering the evidence against Amber Guyger on Monday and Wednesday.

She was initially arrested on a manslaughter charge, three days after the Sept. 6 shooting death of Botham Jean.

The Dallas County district attorney's office plans to announce the indictment at a 2:30 p.m. news conference likely to be attended by Jean's family and their attorneys.

Dallas police said Friday they are seeking a warrant for manslaughter charges against one of their own after an off-duty officer entered the wrong apartment in her building and killed a man who was inside.

Police Chief Reneé Hall said a blood sample was drawn at her request to test the officer's drug and alcohol levels and "we are in the process of obtaining a warrant based on the circumstances."

She said at a news conference that the Texas Rangers were launching an independent investigation.

A Dallas man was killed late Thursday when a police officer returning home from her shift entered the wrong apartment in her building and eventually opened fire, authorities said.

Details surrounding the death of Botham Shem Jean, a 26-year-old native of St. Lucia, were not immediately available early Friday.

His mother, Allie Jean, said in a phone interview from her St. Lucia home that his family was stunned to learn of his death.

"He did no one any wrong," she said.
Dallas police in a statement said that preliminary information suggests the officer involved called for help, and told responding officers that "she entered the victim's apartment believing that it was her own."

The incident began just before 10 p.m. CT (11 p.m. ET) at the South Side Flats, an upscale apartment complex directly south of Dallas' downtown.

During the encounter, the officer was in full uniform and "fired her weapon striking the victim," police said.
The officer was not immediately identified, and was being placed on administrative leave during the investigation.

At a news conference early Friday, Dallas police Sgt. Warren Mitchell said they had yet to interview the officer and would not speculate as to whether she mistakenly entered another apartment and believed the man already inside was an intruder.

"We still have a lot to do in this investigation," Mitchell added.

Allie Jean said her son lived in a gated apartment complex and had no reason not to trust anyone who was at his door.
"Somebody has to be crazy not to realize that they walked into the wrong apartment," Allie Jean said. "He's a bachelor. Things are different inside."

"And if you try your key and it doesn't work, that should make you realize you're at the wrong apartment," she added. "Every door for each apartment is also numbered."

Allie Jean said she would speak with her son daily, usually before 10 p.m., but thought he might be out after she didn't hear from him.

Wait what. Sounds like the doors might auto lock too. So she didn't think it was odd she didn't need a key to get into her apt, and/or someone had to open the door for her?

Seems extremely fishy. She was either wasted drunk on the job or this was premeditated.

How is this an "administrative leave" situation? She was returning home, she wasn't on duty, right? She wasn't responding to a call? She was just confused? How is this anything less then manslaughter and an arrest?

One time I was super tired and accidentally tried to enter the wrong apartment. (Same apt location but diff building) and I immediately realized things were off when the godamn door knob wouldn't turn with my key. Seriously how does she think this is gonna fly?

Yeah, unless that officer was severely intoxicated (which presents its own problems as she was still in uniform), I don't get how you A) gain entry to another's apartment and B) not realize you've made a mistake when the surroundings look different.

Even leaving that aside, immediately shooting and killing an intruder still seems like excessive force.

What in the flying fuck. This has to go down as manslaughter and expulsion from the force, at the very least. There's no reasonable way you can defend trying to break and enter into an apartment and killing your neighbor. You either have to be actively homicidal, criminally insane or criminally drunk and/or high.

Someone in my building tried to get into my apartment - despite his key not working he kept trying. Course he was drunk but still makes me check my door is always locked. She should go to prison for manslaughter.

my baseless speculation is that the killer had some kind of relationship with the victim (romantic or stalking) and then used their cop powers to murder them.

Well damn, I guess cops are just coming straight into our homes now to kill us. To think a police officer can just waltz into your home, murder you and just be put on administrative leave because it was a mistake. "Oh this isn't my apartment? Whoops!"

Absolutely terrifying. Like what are they even investigating at this point? Trying to get a story together? I am almost 100% sure that they will come out saying something that will place the blame of the victim.

Both potential explanations - that it was premeditated or that she was out of her mind on a substance right after work - seem crazy but I guess we'll find out more soon.

RIP to the victim and I hope the officer gets what's coming to her whatever the story ends up being.
