Legally nothing wrong with this, but if the choice is between asking permission and not asking permission then I would want someone to go with the first one just about every time, if only because using a forum handle that may still be in use or used across multiple media sites could potentially open that person to unwanted attention. The likelihood isn't high, but really the only thing you need to do to make it practically zero is not include the handles.

Would that count as lack of attribution though?

Well, we all agree to the terms of service of the forums we post on. I don't really think anything I post here "belongs" to me and I certainly wouldn't mind if I saw it somewhere else. It's not my name, it's not my picture.

If it's something like a short story, that would obviously be a different thing.

I was just asking my friend if the usernames in there were real because I was already positive that the comments were real.

Personally, I don't really care if they got permission or not as the words that were said were already said publicly, so it's not like they went into private means to get them. I'd think it was funny if one of my comments ended up in the game the way it did here and move on, because mission accomplished.

Completely OK. As is Mega64's usage of forums for scripture in Flame War Theatre. In my eyes the situations aren't much different.

On the one hand: This is a really unique and cool way to deal with shittier criticism and internet comments.

On the other hand: I fully agree with all the people cited within this dankest of caves that an abundance of unoriginally interpreted internet memes is trash tier humor, painfully dates the game and requires virtually zero skill to pull off compared to actually original jokes. And as such i don't think these comments in particular were deserving of being dunked on like this.

It's totally ok imo. I look at something like Mega64 flame war theater the same way . All public forum posts . You can quote whoever you want.

Drinkbox just shot themselves in the foot.

I don't know how much the rest of you know about forum culture (I'm an expert), but honor and shame are huge parts of it. It's not like it is on youtube where you can become successful by being an asshole. If you screw someone over in a forum, you bring shame to yourself, and the only way to get rid of that shame is repentance.

What this means is the forum public, after hearing about this, is not going to want to purchase Guacamelee 2, nor will they purchase any of Drinkbox games. This is HUGE. You can laugh all you want, but Drinkbox has alienated an entire market with this move.

Drinkbox, publicly apologize and erase this area from the game or you can kiss your business goodbye.

This is solid.

Nevertheless, I can't imagine members have much agency in public forums. I bet there's some odd legal bylaw that exonerates the posters from any ownership of what they post.

Because its the same reason why topical humour is looked down upon generally, it dates your product heavily. No ones gonna understand any of the posters plastered in Guacamelee 1 in 5-10 years(or now even), but a forum post is a thing thats happening right here right now, you could go to a different section of the website and probably see a thread about a meme someone just referenced. A game is a time capsule almost, its why stuff like the comedy in Borderlands 2 is so cringey because it's very forced and yet a play off of current events.

The joke made in this thread is literally 10 years old. It's just odd to me that these recycled jokes are celebrated on a forum that talks about video games but are reviled in the video games themselves. To each his own I guess, at the end of the day it's no big deal to me.

I think technically the forum owner is granting permission in that case, because the owner and poster jointly own copyright of the post.

But also these scenarios are all either:

a) Fair Use, or
b) Something that a judge would probably throw out for being petty and wasting their time

Sure. I just honestly never thought anything I posted would end up in a video game. Like 99.9 percent of this shit doesn't end up anywhere.

Also I don't find this funny but I also don't find it offensive. It seems kind of petty and defensive which I guess is a kind of funny.

They absolutely do not remove it, lol. That is how we found out that Ryan Davis, rest his soul, was delivering sick burns to Mark Ruffalo way after he passed. Forums, just like other social platforms, are public. You open yourself to be quoted whenever you write something in them.
