Yeah but lawsuits have outcomes. There's a winner and a loser. He will have to drop the suit. Or lose the suit. Or get scolded for frivolous antics. There is a guaranteed negative outcome for Trump UNLESS the NYT for some reason decides to capitulate. Which they'd be INSANE to do.
And further, Trump is a public figure, a public servant and the NYT already enjoys tremendous First Amendment rights here.
NYT can ask for transcripts, tapes, witnesses, the content's of the National Enquirer Pecker safe - redacted elements from the Mulller probe and so on.
