(CNN)Supreme Court Justice Elena Kagan on Thursday denied a request from Republicans to block Montana Gov. Steve Bullock's directive last month allowing counties to send mail-in ballots to all registered voters amidst the coronavirus pandemic.

Kagan, who has jurisdiction over the lower court involved in the case, turned down the request without referring the petition to her colleagues or asking the other side for its views.

The suit was brought by Joe Lamm of the Ravali County Republican Central Committee as well as several voters.

"While Covid is a national tragedy, it poses no emergency," James Bopp, a lawyer for the plaintiffs, wrote in court papers. Bopp noted that the Montana legislature already allowed any qualified voter to obtain a no-excuse absentee ballot by merely applying.

Lower courts have upheld Montana's directive. Bullock, a Democrat, issued a similar directive in the primary, and all of the state's counties opted to send out mail-in ballots to voters. Bullock will appear on the ballot as a candidate for Senate in November.

Yes, each justice is responsible for certain circuit court petitions. I think relating to certain types of emergency injunctions/stays.

Not sure if the group hating voting can still petition the whole court for review.

They can try again with any other justice (who would probably refer it to the full court), but they are out of time anyway so they don't plan to

Montana doesn't matter (sorry!). Republicans have been trying to disenfranchise voters forever. Mail-in ballots do the exact opposite. The GOP only has power because of inconsistent voter turnout, disenchantment, and gerrymandering. Left-leaning policies are much more popular than conservative ideas so the GOP will do anything to silence the majority.

There is a senate seat up for grabs this year.
They're going to fight for every point if the polls are to believed
They're concerned (rightfully) that they are going to lose the Senate race
Governor race, currently held by a dem.
Senate race, competitive.
It's not really likely the 3 electoral votes are in play but other races are competitive.
They're in a fight for the Senate. Dems are in striking distance there. The person running is Steve Bullock, the current Democratic governor there.

every state matters. Republicans figured out local politics is the cheapest way to win political power and dems should do it even harder.

It's precedent. Montana is just a tiny piece of the whole puzzle.
Montana matters for it's possible senate seat. And the fact it is one of those interesting rural states that has a Dem governor. Montana may not be worth it for the presidential race, but Dems having as many state level leadership positions is critically important. It's something Dems need to never let get to the state it was in nationally by the time 2016 hit ever again.

Montana actually matters quite a lot to those of us who live there, thank you very much. Even beyond the competitive senate race, there are incredibly important state and local races this time around.

The senate is in play and Montana's senate race is competitive, largely due due to Bullock being the candidate.

With the Emerson poll that came out today and Daines leading every poll since the summer, it feels like Montana has slipped away from the Dems when it was probably an option at one point. It just seems like Bullock has lost ground and in a state that goes so heavily in favor of Trump, that's practically a death sentence for a candidate already teetering on the line of viability.
