After all, Nintendo can't tell developers to use a stricter ESRB rating than ESRB gave to a title, so I fail to see what you are actually proposing.

The ESRB system in general being flawed is a different topic, though. Difficult to actually change though as rating agencies that actually play through the games they test can't cope with the sheer number of games released these days.

The game is rated E10+ and every 10 year old on Earth has said asshole before, or whatever their native language's equivalent is.

No; just that Nintendo should do due diligence and make sure that they haven't been tricked. It's possible, from my understanding, to fake a rating. (You can lie to the ESRB, at the very least.) Last I checked, perhaps I'm wrong, but asshole isn't appropiate for a E+10 game, so someone uploading the game to the e-shop should have caught that just by giving the trailer a once over.

Nintendo recently made a statement about censorship saying that they will not do anything of the sort because that's what the rating boards are for. This game has a rating so why would they waste their time and money going through it to check and see if it has bad language or content. It's not Nintendo's job to check if a dev lied to the ESRB. If you are actually that bothered by this, then send in a complaint to the ESRB, and, if they agree with you and change the rating, Nintendo will pull the game from their store until the new rating can be applied.

Bringing up Nintendo at all in this context is just being inflammatory.

Why don't you report the dev to the ESRB instead of whining on here? What do you want us to do? If seeing the word asshole has affected you that much report them. jesus

Well, my understanding was that "asshole" obviously inappropriate for E+10 ratings. I can tell you for a fact that 10 years ago it wasn't. So, by that standard, that would be an indication something was amiss.

I mean, imagine if there was an obvious porn game on the e-shop rated "E+10"; I don't think this excuse would work. Now, "asshole" is much less severe than that, but a quick review of at least the content to be posted on the e-shop page is not unreasonable to make sure everything lines up and nothing is amiss.

My sixth-graders read books (not ones I picked, mind you) with asshole, shit, and the like. They're fine. They've heard it all by that age and have the abstract thinking ability to know when it's okay to swear and when it's not. Now do I use bad language while teaching or talking to them? Of course not. But as part of storytelling they can handle it at age 10-11.

OP, what do you think would happen if Nintendo double checked all of the games on their store?

In 99.999% of cases, they'd end up with the exact same result that the ESRB got and would have only succeeded in wasting a bunch of money. And in those 0.001% of cases where they came up with a different result, they'd tell the ESRB to re-rate it.

Which is the same thing that we could do after checking the games just by complaining to them.

As a dev: if your game is digital only you self rate it through IARC on Switch. So you basically fill in an online form and get all the various ratings. The game is normally not checked by ESRB / PEGI and so on.
It's up to the developer, not Nintendo, to get the appropriate age rating for a game.

I'm sure 'asshole' is not admitted for ESRB 10+. You'll get at least a Teen rating.

You really seem to be going out of your way to try to make this about Nintendo for some reason.

This is entirely uncalled for dev blaming / demonization, especially considering T-rated products actually sell better than E-rated ones (movies often include a swear word or two to intentionally get a T rating). Assumption of malice, especially out of personal disagreement with what's acceptable in an E10 product, is unwarranted.

Incidentally, the game itself looks pretty interesting. It's a shame this is the only thread about it on Era (I came across it looking for information on it).

Not really sure what the OP is looking for in this thread. Asshole falls under the "some/mild" language that would be allowed in a E10+ game. This is no different than PG movies.

But if this happened they'd have to get it past the ratings board somehow and the ratings board would be the ones to handle the issue/ban the game/fine the devs or whatever they decided to do, it would still be nothing to do with Nintendo.

But there's nothing to suggest anything like this has happened here anyway.

E10+ came about in 2005 and "mild language" was always allowed, even then.
