I haven't seen a thread about this, so close if this is old. Thanks.

Update:

Link to song from the EPA website:

https://www3.epa.gov/recyclecity/challenge/music/yoshidsunderground.mp3

Update 2:

Apparently, this site has been up since 2017, where a Twitter comment confirmed it was archived to the Web Archive database since 2017.

Web Archive link:

https://web.archive.org/web/20170201135507/https://www3.epa.gov/recyclecity/challenge/index.html

Update 3:

The EPA responds!

"The Recycle City Challenge game was created for EPA by a contractor. We are looking into whether the contractor received permission to use the music, to the extent permission was necessary in this instance," an EPA spokesperson told The Hollywood Reporter.

The music's apparently been turned off as well; undoubtedly, Yoshi himself had a hand.

EPA has taken down the music audio. But you can still hear the music from Web Archive:

It's just the US seizing Yoshi's assets after his many years of tax fraud. Nothing unusual.

building stone people
The US government just shot themselves in the foot.

I don't know how much the rest of you know about Japanese culture (I'm an expert), but honor and shame are huge parts of it. It's not like it is in America where you can become successful by being an asshole. If you screw someone over in Japan, you bring shame to yourself, and the only way to get rid of that shame is repentance.

What this means is the Japanese public, after hearing about this, is not going to want to play "Recycle City Challenge" for either system, nor will they play any of the government's games. This is HUGE. You can laugh all you want, but the US government has alienated an entire market with this move.

USA, publicly apologize and cancel Recycle City Challenge or you can kiss your government goodbye.

In what way is it fair use?

This isn't me disagreeing, but people have been dropping "fair use" anytime they get caught out using copyrighted material without permission. Is it because it's being used in an educational, non-profit manner?
"Educational fair uses" is supposed to cover cases, where someone wants to educate about something and she needs the copyright material to make her case. Then it's okay to use it, as long you only use the parts, which are needed to make your point.
You can't just use anything, just because you make something educational or because it is free. In this case, the song has nothing to do with the subject. So it would be illegal use.

That's what I was figuring.

No sympathy for the tax evader

It says a lot about the state of our government where I'm not sure you're talking about Trump the Yoshi meme.

I mean, legally the IRS can seize any and all of Yoshi's assets to cover his flagrant tax evasion. So it could well be that the federal government has just taken title to the song.

Always pay your taxes on time and in full. The Internal Revenue Service is no joke.
