US Immigration and Customs Enforcement (Ice) is to carry out a final deportation flight of the Trump era on Tuesday, with a plane bound for Haiti whose passengers include a man who is not a Haitian citizen, and who has never been there.

Paul Pierrilus, a 40-year-old financial consultant from Rockland County, New York, was born in the French Caribbean territory of Saint Martin, according to a birth certificate supplied by his family, who said he came to the US with his parents when he was five. His sister and parents are US citizens.

He was picked up on 11 January, as part of what human rights advocates say is a last sweep of black migrants in the final days of the Trump administration. He has told his family he was being transferred to an Ice holding facility in Alexandria, Louisiana, which is a typical precursor to deportation.

"He went there for the appointment and while he was there, he was detained, and he was informed that they have documents stating that he's a Haitian citizen," Neomie Pierrilus said.

Neomie Pierrilus supplied copies of emails last year from the then Haitian ambassador, Hervé Denis, confirming that her brother was not a Haitian citizen.

They can't deport you until they get travel documents from the country they are sending you to. If Haiti refuses him, then that individual cannot be deported. They will remain detained until the U.S. is able to secure travel documents for them or they are let out of detention. However, if the article is true and they are ready to put him on a plane then it means the U.S. was able to secure said documents, meaning the Haitian government accepts that he is their citizen.

The article doesn't mention if his parents were US citizens when he was born, or if his parents and sister gained citizenship later in life. Either way, the cruelty is definitely the point.

Can somebody fill me in on why ICE settled on Haiti? The article says it's been flying planes there every second Tuesday, but doesn't explain if these situations have only involved Haitian citizens or if it's just some drop-off point ICE arbitrarily settled on.

Haiti would presumably send him back to the US.

It's hard to say what would apply since he was born in the French side of Saint Martin.

His parents were Haitian at the time, but they never registered his birth, so he's not a Haitian citizen.

France doesn't have birthright citizenship, so he's not a French citizen either.

He's lived in the US since the age of 5, so the majority of his life has been in the US.

That said, if he is technically stateless, I don't see how it is legal to deport him to a third country.

Naturalized US citizens. They weren't citizens when he was born, so he wouldn't automatically get it.

Speculating, maybe Haiti agreed to accept whoever for some cash. Or they were bullied into it.
