Vice President Pence was sued Sunday by Rep. Louie Gohmert (R-Texas) and several other Republicans in a far-fetched bid that appeared aimed at overturning President-elect Joe Biden's election win.

The lawsuit focuses on Pence's role in an upcoming Jan. 6 meeting of Congress to count states' electoral votes and finalize Biden's victory over President Trump. Typically, the vice president's role in presiding over the meeting is a largely ceremonial one governed by an 1887 federal law known as the Electoral Count Act.

But the Republican lawsuit, which was filed against Pence in his official capacity as vice president, asks a federal judge in Texas to strike down the law as unconstitutional. The GOP plaintiffs go further: They ask the court to grant Pence the authority on Jan. 6 to effectively overturn Trump's defeat in key battleground states.

Election law experts were dismissive of the lawsuit's prospects for success.

There should be some grounds for something due to the amount of stress and anxiety these fools are causing a lot of people. This shit shouldn't even be in the public conscience yet here we are everyday a new way in which they are trying to take the election from Biden

Gohmert sues VP Pence over role in declaring Biden as winner of election

Congressman Louie Gohmert (R-Tyler) has sued the vice president in the hope of flipping the election to President Trump.

More specifically, Gohmert's suit objects to the counting of the Arizona slate of electors voting for Biden and to the Biden slates from the remaining Contested States. It states that when Congress convenes on January 6 to count the electoral votes and declare President-Elect Biden as the winner, Gohmert will formally object to the count which, the lawsuit states, is a privilege he is entitled to "under the Twelve Amendment" (sic). Further, Gohmert is also asking Judge Jeremy Kernodle, a President Donald Trump-appointed district judge in Tyler, to find that Pence is authorized to pick pro-Trump electors on January 6.

"Please make up laws to help Trump"

No and the election was closer. The party that claimed Obama would declare himself King, watched Clinton concede in a close election, and are now demanding Trump declare himself King.

Only one party values Democracy anymore, but it's more than that, it's about half the country and the other half doesn't.

Gohmert's cohorts include ex-"Kraken" plaintiff Tyler Bowyer and the Arizona Republican Party's chairwoman Kelli Ward, whose call for Trump to #CrossTheRubicon was widely interpreted as pining for the president to establish dictatorship just like Julius Caesar did.

According to the lawsuit, the Vice President "may exercise the exclusive authority and sole discretion in determining which electoral votes to count for a given state, and must ignore and may not rely on any provisions of the Electoral Count Act that would limit his exclusive authority and his sole discretion to determine the count, which could include votes from the slates of Republican electors from the Contested States."

It further contends that the Electoral Count Act "limits or eliminates [the Vice President's] exclusive authority and sole discretion under the Twelfth Amendment to determine which slates of electors for a State, or neither, may be counted."

These assertions are simply false. The election results in every U.S. state have already been certified and the Electoral College votes for Biden have already been cast. There is absolutely no constitutional provision allowing for states to have "competing" or "alternate" slates of electors. The "votes" those groups sent to Congress do not have any legal authority.

As Law&Crime explained in a previous post, the Twelfth Amendment only dictates that the VP, as president of the Senate, "open all the certificates" and nothing more.

U.S. District Judge Jeremy Kernodle, an appointee of President Donald Trump will preside over the case in the Eastern District of Texas.

UC Irvine law professor Rick Hasen said Gohmert's legal challenge "won't work," while national security attorney Bradley P. Moss called the lawsuit "garbage."
