NEW YORK -- President Donald Trump's accountant must turn over his tax records to a New York state prosecutor, an appeals court ruled Wednesday.

The 2nd U.S. Circuit Court of Appeals in Manhattan said a stay of a lower-court decision will remain in effect so Trump's lawyers can appeal the ruling to the U.S. Supreme Court.

A district court judge had rejected their renewed efforts to invalidate a subpoena that the office of Manhattan District Attorney Cyrus Vance Jr. issued to Trump's accounting firm.

A Justice Department spokesperson said the department was reviewing the ruling.

The Supreme Court in July ruled 7-2 against the president. It is down to eight justices after the death of Ruth Bader Ginsburg.

The matter may not be fully resolved before the November election.

Will definitely not find anything out until after the election regardless.

Hasn't this already been up to the supreme court and back again? How many stops does this train have, can you essentially just appeal indefinitely?

Even if he doesn't turn them in, just remember that the New York Times have already gotten ahold of his taxes & can easily leak them at anytime.

Presumably they will still appeal again and keep pushing it down the road, yes? Serious question: at which point it's no longer possible to appeal and the case has to be resolved one way or another?

From the article I posted earlier:
"In July, the Supreme Court rejected Trump's contention that a sitting president is immune from any part of the criminal justice system, including grand jury investigations. But its decision said he could make the same arguments anyone can in trying to defeat the subpoena."

Slight distinction between the two, but in July his argument to the SC was, essentially, that he's above the law. The SC disagreed and kicked it back to the lower court allowing for Trump to make the same arguments anyone else can make against a subpoena.
Now, he'll probably argue the subpoena itself is overly broad and unduly burdensome, which will probably not be persuasive as NY DA is only asking for 8 years of tax returns.

The Supreme court should do its actual job now and refuse to hear the (new) case. There is absolutely zero reason for them to hear a standard case about an overbearing state subpoena if there are no issues of executive privilege on the line.

Agreed. Trump needs four of the 8 sitting justices to decide to hear this case. He'll probably get 2 or 3, but I don't see who the fourth would be.
